1. Acceptance of Terms

By downloading, installing, accessing, or using the EmeChat application or the website https://eme-chat.online, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you are strictly prohibited from using EmeChat.

2. AI Translation & Speech Disclaimer ("AS-IS" Provision)

All real-time text, speech-to-text (ASR), and text-to-speech (TTS) translations on EmeChat are generated by automated machine-learning models (including Sherpa-ONNX & Piper VITS) and are provided strictly on an "AS IS" and "AS AVAILABLE" basis without any express or implied warranty.

• EmeChat does not guarantee 100% semantic, grammatical, or contextual translation accuracy.
• In no event shall EmeChat, its founder, or developers be held liable for any translation errors, misinterpretations, commercial losses, personal disputes, defamation, or damages resulting from automated translation outputs.

3. Intermediary Status & User Content Safe Harbor

EmeChat operates strictly as an intermediary communications platform under Section 79 of the Indian Information Technology Act, 2000, and corresponding international intermediary safe harbor laws.

• EmeChat does not initiate, select, modify, or monitor user-transmitted messages or media.
• Users are solely, independently, and legally responsible for all text messages, voice recordings, images, files, and links sent through their accounts.
• Transmitting illegal, harassing, fraudulent, or infringing material is strictly prohibited.

4. Limitation of Liability (Strict $0 Damage Cap)

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EMECHAT, ITS DEVELOPERS, OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION).

THE TOTAL AGGREGATE FINANCIAL LIABILITY OF EMECHAT FOR ALL CLAIMS OR DISPUTES IS STRICTLY LIMITED TO ZERO RUPEES (₹0 INR) OR THE EXACT AMOUNT PAID BY YOU TO EMECHAT IN THE PRECEDING TWELVE (12) MONTHS.

5. User Indemnification Agreement

You agree to defend, indemnify, and hold harmless EmeChat, its founder, developers, hosting partners, and affiliates from and against any third-party claims, liabilities, lawsuits, damages, losses, penalties, and legal fees (including attorney costs) resulting from your account usage, violation of these Terms, or infringement of any third-party right.

6. Governing Law & Exclusive Jurisdiction Lock

These Terms shall be governed by and construed in accordance with the laws of India.

7. Signal Protocol E2EE Zero-Knowledge Architecture

EmeChat utilizes Signal Protocol end-to-end encryption. Private keys reside solely inside hardware KeyStore containers on user devices. EmeChat operates zero-knowledge message servers and cannot decrypt, read, intercept, or produce unencrypted message text or call audio to any party, law enforcement, or court authority.

8. Age Restriction & Child Safety (13+ Minimum)

EmeChat is intended strictly for individuals aged 13 years or older. Minors under 13 years of age are strictly prohibited from creating accounts or submitting personal data.

In accordance with Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 under Section 79 of the Indian Information Technology Act, 2000, official grievance disclosures are listed below:
